Truck Accident Litigation

Our Experience

Hornblower Manning & Ward has handled an extensive docket of truck accident cases all across the State of Texas. In the five years from 1995 to 2000, the Firm handled over 150 accident cases involving commercial trucks. During that time, the firm has demonstrated the benefits of early response and effective liability assessment of truck accidents, in coordination with experienced and qualified accident investigators and reconstruction experts.

The Firm has handled litigation arising from a wide variety of motor vehicle accidents, including the following types of truck accidents:

  1. Head on collisions
  2. Rear end collisions
  3. Broadside collisions
  4. Right hand squeeze (car attempts to pass truck on right side while truck is making a wide right turn)
  5. Center line bump and lane change collisions
  6. Stationary or slow-moving trucks hit from behind by other vehicles
  7. Jack-knifed trailers
  8. Vehicles sliding under trailers
  9. Vehicles losing control on road in front of or near eighteen wheeler
  10. Loss of control by truck driver, including single vehicle rollovers.
  11. Alleged hit and run or bump and run cases

Truck Accidents are Different:

Truck accident cases present unique challenges and issues not usually encountered in typical motor vehicle accident cases, including:

  1. Greater likelihood of substantial damage claims
  2. Juror prejudice against truck drivers and trucking companies.
  3. Claims of negligence in the areas of driver hiring, qualification and training
  4. Claims of negligence in the areas of vehicle maintenance
  5. Conflicting or overlapping insurance coverages for leased tractors or trailers
  6. Claims by co-drivers or unauthorized passengers
  7. Claims by employees covered by workers' compensation insurance in a different state
  8. Subject to more governmental regulations than non-commercial vehicles
  9. Unique physical limitations on driver and equipment due to the size and bulk of vehicles.
  10. Identification of vehicle operation and ownership in alleged bump and drive cases.
